9:1-27 Joshua once again failed to consult God (9:14; cp. 7:2-4), this time over an unexpected request. Other ancient Near Eastern accounts tell only of a leader’s triumphs; this author also recorded the shortcomings of Joshua and Israel’s elders. The real hero of the story is God, whose accomplishments the author wished to tell.

The author is not referring to a specific Hivites. He means the Gibeonite messengers, who were Hivites. It may be more natural in your language to express this meaning by using a plural form. Alternate translation: “these Hivites”

The Israelite leaders are using the question form for emphasis. If a speaker of your language would not use the question form for that purpose, you could translate this as a statement or as an exclamation. Alternate translation: “In that case, we could not cut a covenant with you!”
